Article 1 — Purpose and scope
These terms and conditions of sale (hereinafter the “T&Cs”, “CGV”) govern exclusively the sales of sewing machines and accessories offered by VESXPRESS, 46 CLOS SAINT-CORNEILLE, 60410 VERBERIE, FRANCE, on the site vesxpress.com. Any order implies unreserved acceptance of these T&Cs, which the customer expressly acknowledges by ticking the box provided for that purpose when confirming the order.
The applicable T&Cs are those in force on the date of the order. Vesxpress reserves the right to amend them at any time, such amendments having no retroactive effect on orders already confirmed.
Article 2 — Products
The products offered are professional and semi-professional sewing machines powered at 220-240 V / 50 Hz, together with the associated accessories. Photographs and descriptions are illustrative and do not constitute a contractual commitment; slight variations in finish, colour or packaging may exist depending on the manufacturer’s batches.
The essential technical characteristics (supply voltage, power, type of drive, dimensions, weight) are indicated on each product page.
Article 3 — Prices
Prices are expressed in euros (€). They are displayed incl. VAT (all taxes included) for deliveries in France and in the European Union — including French VAT at the rate of 20 % — and excl. VAT (excluding taxes) for deliveries outside the European Union, the sale then constituting an exempt export.
The applicable VAT is calculated automatically at the basket stage according to the customer’s delivery address. A customer delivered outside the European Union therefore benefits from the removal of French VAT from their total.
Vesxpress reserves the right to modify its prices at any time; the applicable price is the one displayed at the time the order is confirmed.
The total price payable comprises the price of the products and, where applicable, the delivery costs, indicated before final confirmation of payment.
Article 4 — Order
The order is deemed concluded when the customer has confirmed their basket, accepted these T&Cs and proceeded to payment, and an order confirmation e-mail has been sent to them. Vesxpress reserves the right to refuse or cancel any order in the event of a prior dispute, suspicion of fraud, an incomplete address or unavailability of the product.
The contractual information is kept by Vesxpress and may be provided on written request.
Article 5 — Payment
Payment is made online by bank card (Visa, MasterCard, American Express), by PayPal or by bank transfer. Transactions are secured by our payment provider, in accordance with PCI-DSS standards; banking data never passes in clear text through our servers.
The customer warrants that they are fully authorised to use the means of payment employed. In the event of non-payment, the order is automatically cancelled.
Article 6 — Delivery
The arrangements, timeframes, areas and costs of delivery are set out in detail in our Shipping and Returns Policy, which forms an integral part of these T&Cs. Timeframes are indicative; a reasonable delay cannot give rise to cancellation or compensation, save for any contrary legal provision.
Transfer of risk takes place on physical delivery of the product to the customer. It is for the customer to check the condition of the parcel on delivery and to issue reservations to the carrier where appropriate.
Article 7 — Right of withdrawal
The consumer customer has a period of 14 days from receipt to exercise their right of withdrawal, without giving reasons, under the conditions set out in the Shipping and Returns Policy. The legal exceptions (personalised goods, unsealed goods) apply.
Article 8 — Guarantees
All products benefit from the legal guarantee of conformity (2 years) and the guarantee against hidden defects, under the statutory conditions. The manufacturer’s commercial guarantee, where it exists, is additional to and does not replace them; its duration and scope are specified on the product page or in the documentation provided.
The guarantee does not cover normal wear, consumables (needles, belts, oils), or damage resulting from non-compliant use, an inadequate power supply, repair by an unauthorised third party or a lack of maintenance.
Article 9 — Liability
Vesxpress is liable as of right for the proper performance of the contract. Its liability may not, however, be incurred for indirect damage, loss of business or non-material harm. The liability of Vesxpress is in any event limited to the amount of the order concerned.
Article 10 — Force majeure
Neither party may be held liable for a failure resulting from an event of force majeure within the meaning of Article 1218 of the French Civil Code. Performance of the obligations is suspended for the duration of the event.
Article 11 — Intellectual property
All the elements of the site (texts, photographs, logos, trade marks, databases, code) are protected by intellectual property law. Any reproduction or representation, in whole or in part, without prior written authorisation, is prohibited and constitutes infringement.
Article 12 — Personal data
The processing of personal data is described in our Privacy Policy, in accordance with the GDPR.
Article 13 — Mediation and settlement of disputes
In the event of a complaint, the customer should first contact our customer service at contact@vesxpress.com or on (+33) 7 57 82 02 38. Failing an amicable solution, the consumer customer may have free recourse to a consumer mediator. This contract is governed by French law; the French courts have jurisdiction, subject to the protective rules applicable to consumers.
Article 14 — Language and acceptance
These T&Cs are drafted in French; any translations thereof are provided for information purposes only and the French version shall prevail in the event of divergence. Acceptance of the T&Cs is evidenced by the checkbox at the time of the order.
